No Purchase Required to Enter or Win/A Purchase Will Not Increase Your Chances of Winning
1. Eligibility: The Thompson’s® Water Seal® VIP Sweepstakes (the “Sweepstakes”) is open only to individuals who are legal residents of the fifty (50) United States or the District of Columbia and are eighteen (18) years or older at the time of entry. Employees of The Sherwin-Williams Company and related companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all federal, state, and local laws and regulations and is void where prohibited by law.
2. Sponsor: The Sweepstakes is sponsored by The Sherwin-Williams Company d/b/a The Thompson’s Company, 101 Prospect Avenue, N.W., Cleveland, Ohio 44115 (“Sponsor”).
3. Agreement to Official Rules: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules in a timely manner.
4. Entry Period: The Sweepstakes begins on April 1, 2008 at 12:00:01 a.m. Eastern Time (“ET”) and ends on September 30, 2008 at 11:59:59 p.m. ET. Entries received outside of the Entry Period will be disqualified.
5. Entry: To enter, access the internet Web site at www.thompsonswaterseal.com and follow all instructions for completing the official online entry form. The entry begins with a quick and easy virtual deck makeover. Guests can choose a park background to set the scene for their deck project. Next they answer a few entertaining and informative trivia questions on the three parks and Thompson’s Water Seal products as they move through cleaning and protecting the deck. (You don’t have to answer the questions correctly to enter.) There is no cost to register. Only complete entries will be accepted or entered into the Sweepstakes. Only one (1) online entry per person, household, e-mail, or street address will be accepted. Once submitted, entry cannot be modified, deleted or returned. Proof of online submission is not considered proof of delivery or receipt. Non-conforming entries are void and will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes entry services) or multiple e-mail addresses will void all entries by that entrant.
6. Winner selection/Odds: Winner will be selected in a random drawing on or about October 10, 2008 from among all eligible entries received. Odds of winning will depend on the number of eligible entries received. Winner will be notified by telephone, email and/or mail. If the potential winner cannot be contacted within ten (10) days after the first attempt to make contact, potential winner will be deemed to be ineligible and disqualified. In such event, Sponsor will draw an alternate, potential winner.
7. Requirements of the Potential Winner: Except where prohibited, the potential winner once contacted will be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”), within ten (10) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, potential winner will be deemed to be ineligible and disqualified. In such event, Sponsor will select an alternate potential winner.
8. Prize: One (1) Grand Prize of the winner’s choice of a trip to one of three VIP (Very Important Places) described below. The Grand Prize package consists of coach class, round-trip airfare on a carrier selected by Sponsor in its sole discretion for up to four people from the airport nearest winner’s home within the 50 United States or the District of Columbia to the winner’s choice of one of three airports (Buffalo, New York for Niagara Falls State Park, Bozeman, MT for Yellowstone National Park or Kallispell/Glacier, MT for Glacier National Park), lodging for four nights selected by sponsor, a rental car for five days, and $1,000 spending money. Additionally, each destination will offer a special “VIP event” for the winner that is not available to the general public:
- Niagara Falls – VIP tour of the Cave of the Winds Decks and front row seat at the evening illumination ceremony for the Falls.
- Glacier National Park – VIP tour of the Park’s Greenhouse, led by the Director, who will explain their leading-edge work in helping grow and re-introduce native plants for Parks and highway projects around the country.
- Yellowstone National Park – VIP walking tour and lunch at the 100-plus-year-old Old Faithful Inn, which is on the National Register of Historic Places and is one of the few remaining log hotels in the U.S. It also is adjacent to the Park’s most well-known attraction, the Old Faithful Geyser. This tour includes access to parts of the hotel not open to the public.
All expenses not specifically provided for by Sponsor in these Official Rules are the sole responsibility of the winner. Total value of the prize package is $5,000. Actual value of prize depends on certain factors including, but not limited to point of origin and chosen destination. All applicable taxes associated with the prize are solely the winner’s responsibility. No transfer, assignment, or substitution of prize except by Sponsor due to prize unavailability, and then for a prize of equal or greater value. Sponsor will not replace any lost or stolen tickets, vouchers, certificates or other prize items once they are in the winner's possession. Each guest (or guardian) will be will be required to sign a travel release prior to departure. Winner and all guests must travel together on the same itinerary. The winner must complete the trip within one year of acceptance of the prize. The winner may elect to take the trip at any time within that year, but the Sponsor is not liable if specific lodging or attractions are not open/available at the time that the winner elects to travel. The winner understands the Cave of the Winds decks at Niagara Falls State Park are open seasonally between late April/early May and late Fall. Specific open dates vary by year. Different attractions at Yellowstone National Park and Glacier National Park may be closed at different times of the year based on weather conditions. If the winner elects to travel at a time when the Cave of the Winds decks or attractions at other parks are not open, there will be no additional compensation to the prize package. Sponsor also reserves the right, working in conjunction with park staff, to change the VIP offering at any of the three locations if the original offer becomes unavailable. Travel arrangements must be made through Sponsor’s agent at least 60 days prior to travel.
9. Publicity/License: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, voice, opinions, biographical information and state of residence for promotional purposes in any media without further payment or consideration.
10. Privacy: All information submitted to Sponsor as part of this Sweepstakes will be treated in accordance with The Sherwin-Williams Company Privacy Policy, available at http://www.thompsonswaterseal.com/about_us/privacy_policy.cfm.
11. General Conditions: Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, or to be acting in violation of these Official Rules. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules, or (b) award the prize via random draw from Sweepstakes entrants at the time of the impairment. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
12. Release and Limitations of Liability: By participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor, its officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of any prize. Entrant further agrees that in any cause of action, Sponsor’s liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall Sponsor be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
13. Disputes: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Sweepstakes, but in no event attorneys’ fees or expenses; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
14. Sweepstakes Results: For the winner’s name, available after November 30, 2008, send a separate, self-addressed, stamped envelope to Thompson’s®Water Seal®VIP Sweepstakes, 3333 Lee Pkwy. #450, Dallas, TX 75219. All requests must be received by February 1, 2009.
